Article 2 – Acceptance of the terms and conditions
We recommend that you print or save a copy of the Terms and Conditions on your hard drive when you have decided to place an order through eu.restrap.com.
Article 3 – License to use website
Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved.
You must not:
(a) republish material from this website (including republication on another website);
(b) sell, rent or sub-license material from the website;
(c) show any material from the website in public;
Article 4 – Acceptable Use
You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

Article 5 – Restricted Access
Access to certain areas of our website is restricted. We reserve the right to restrict access to other areas of our website, or indeed our whole website, at our discretion.
If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that the password is kept confidential.
You must notify us in writing immediately if you become aware of any unauthorised use of your account or password.
You are responsible for any activity on our website arising out of any failure to keep your password confidential and may be held liable for any losses arising out of such a failure.
You must not use any other person's user ID and password to access our website, unless you have that person's express permission to do so.
We may disable your user ID and password at any time in our sole discretion with or without notice or explanation.
Article 6 – User Content
You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your content in any existing or future media. You also grant to us the right to sub-license these rights and the right to bring an action for infringement of these rights.
Your content must not be illegal or unlawful, must not infringe any third party's legal rights and must not be capable of giving rise to legal action whether against you or us or a third party (in each case under any applicable law).
You must not submit any content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.
We reserve the right to edit or remove any material submitted to our website, or stored on our servers, or hosted or published upon our website.
Article 7 – Prices & transport
The prices mentioned on the website eu.restrap.com are inclusive VAT, but exclude delivery charges unless expressly exclusive shipping costs.
The price you pay is the price displayed on this website at the time we receive your order. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund
The delivery charges will be shown in the Checkout Page when placing the order.
All orders above 120€ are shipped free.
All other orders will be charged a shipment fee according to the weight of the order :

All orders shipped to Benelux & Germany will be delivered within 1-3 days from shipment.
For all other countries in the EU orders will be delivered within 3-5 days from shipment.
For some regions delivery might be a bit longer and include extra paperwork: Consult us if you are from the following regions: Finland, Greece, Norway, Canary Islands, Ceuta, Melilla, Azores, Madeira, Albania), Bosnia & Herzegovina, Cyprus (EU), Faroe Islands, Iceland, Kosovo, Malta, Macedonia, Montenegro, Servia
The goods are transported at the expense and risk of the buyer. The term of delivery is done by mutual consent and will always be determined reasonably. In principle, orders ordered before 14pm and paid online, are shipped the same day. A delivery date should be considered a non-binding estimate and not a result commitment to deliver the products to the target date. We advise you to enter a delivery address where someone is present as often as possible to receive your shipment (e.g. Your work address). On the day of the sending of the goods the customer will receive an e-mail by our transporter (GLS). This email informs you about the delivery date and the approximative delivery time. If you know that you'll not be present at the time of delivery, you will be able to change the delivery address via a link on that mail.
In case the delivery or receipt can’t take place because the buyer specifies the wrong delivery address so that the delivery fails or waits too long to give new instructions to the carrier, the goods will be returned to us. If the goods cannot be delivered within 7 days after the first delivery attempt and return to us, the buyer has the right to withdraw the purchase. We will refund the total amount of the order in accordance with our arrangements for taking back products and the applicable statutory provisions. All delivered packages have a proof of delivery and are insured.
Article 8 – Method of payment
Only online payment are accepted on eu.restrap.com and facilitated by the ShopifyPayments module.
We do not have access to the confidential details of payment of our customers. Payment can only be made by authorized credit or debit cards. The authorized cards are mentioned on the website eu.restrap.com. You will need to provide the details of the card when you place your order. The costs will be charged when the ordered Products are dispatched. We will only dispatch the Products after the issuer of the card has authorized the use of the card for the payment of the ordered Products.
Article 9 – Product images
The display of the colours of the products on eu.restrap.com partly depends on the settings of the monitor and graphic card from the website. Shown colours may therefore vary from the actual colours of the products.
Article 10 – Availability & Acceptance of Delivery
The Seller does not guarantee that all Products shown on the website eu.restrap.com are available. The Seller reserves the right, at any time and without prior notice, to change certain Products, to remove them from the assortment or to no longer make them available for sale.
Within a reasonable period from delivery, you should verify whether you have received the Products in good condition and whether the contents of the delivered package are complete. It is your responsibility to inform us as soon as possible of any damage to the Products and/or any shortages in the Products delivered.
Article 11 – Warranty
All of the products of our webshop eu.restrap.com have LIFETIME GUARANTEE against defects in material and / or workmanship.
This warranty only applies to the original owner (first buyer) and doesn't apply to any damage caused by incorrect use, accidents, neglect, misuse, incorrect maintenance, wear and tear, unprescribed use by the manufacturer or damage by heat or contact with solvents. If a non-authorized party damages the product in its attempt to repair it, the warranty isn't applied.
When a defect in material or in workmanship is notified to RESTRAP (firstname.lastname@example.org), the Seller will first attempt to repair the product. Only if a product can't be repaired or a spare part is irreplaceable, which is determined by the Seller, the product can be replaced. Any damage to or loss of the contents of a bag, loss of use, loss of time, or similar expenses are not covered.
In order to repair or to credit products, claims can be evaluated by us (RESTRAP) only if we receive the correct photographic material and information of the defective product. The documents requested are: pictures of the defect, proof of purchase and the date of purchase.
Items must be returned "cleaned", items returned with loose dirt or debris will not be repaired. You are responsible for the cost of shipping your item to us.
Normal wear and tear is not covered by this warranty. Examples are: rips, tears, peels, broken zipper and fading.
In case the warranty can't be applied (normal wear & tear or incorrect use) the spare parts can still be delivered but at cost price.
RESTRAP EU Store can't be held responsible for any indirect damage (e.g. (non-exhaustive) loss of profit, damage to third parties,...).

Article 12 – Retention of property
The (delivered) products remain our property until full payment of the price, possibly increased by interest and costs.
Article 13 – Right of withdrawal & returns
The consumer has the right to notify the company that he renounces the purchase without penalty and without giving any reason within 30 calendar days from the day following the delivery of the goods. (Art. 46, section 2, Distance selling). If you purchased a product for your own personal use as a consumer and you want to use your right to withdraw from the contract, you have to contact our customer service within 30 days from the day following the delivery via email (email@example.com) to notify and request a return or exchange. Read carefully the instructions on https://eu.restrap.com/pages/returns-and-warranty to know how to proceed.
We will in any case only approve requests for return if it concerns a complete product (for example, the two elements of a pair must be returned together), the Product has not been washed or used in any way (other than reasonable wear and tear from examining and/or trying on the Product), and the Products are returned in the original packaging.
It is your responsibility to ensure that the Products remain safe and protected while under your custody. Treat the Products with care and return them in the condition in which they had been delivered to you. Please ensure that the Products are packaged appropriately and that postage costs are sufficient.
Return or replacement of the Products can only take place after we have received all of the Products to be returned. Returns are made on the risk and at cost of the sender, in this case the customer.
In case you return Products which you
- where not authorized to return,
- which are no longer in their original state,
- which have not been packaged appropriately,
- which are incomplete,
- for which you have not paid sufficient postage for the delivery
- or in relation to which you have not exercised the care required for returning the Products in good condition,
we reserve the right to reject your return and to reject the requested refund or to charge you for the costs required to undertake the necessary repairs, re-stocking or similar direct costs arising out of or in connection with the payments which need to be refunded to you (without prejudice to the applicable legal provisions). Transport costs incurred by eu.restrap.com to send your order will not be refunded.
You should check this section from time to time to ensure that you are happy with any changes.
Article 15 – Force majeure
If due to force majeure or circumstances outside of our reasonable control we are unable to perform our obligations or if these are unreasonable weighted, we can suspend our commitments during the time of this force majeure, without having to pay compensation.
Article 16 – Exclusion of third party rights
Article 17 – Validity and enforceability
The invalidity of one of the articles of these terms and conditions or a part of it, does not affect the validity of the remaining provisions of these general conditions, neither of these terms in their entirety. Their enforceability remains. In the event of invalidity or unenforceability of any provision of these terms and conditions, the parties shall negotiate in good faith in order to replace it with a provision that most closely produces the same effect as the invalid or unenforceable provision. Likewise the parties will negotiate in good faith to find a solution acceptable to all if a situation arises that is not provided in the terms and conditions.
Article 18 – Amendments to terms and conditions
The Seller is entitled to amend the Terms and Conditions from time to time. Any changes to these Terms and Conditions will only become applicable to orders placed on or after the date of amendment.

Article 20 – Courts of competent jurisdiction
All concluded agreements with Restrap EU Store are governed by Belgian law. In case of disputes, only the courts of competent jurisdiction of the legal district of the registered office of ODISSEY bvba are competent.
